The aim of this programme is to equip the learner with a comprehensive knowledge of the Irish Legal System, the sources of law which govern the process, how it is accessed, the ability to discern between different types of complaint and the remedies available to that complaint, e.g. whether it is a criminal or a civil matter, enabling the learner to know the appropriate forum within which to bring particular complaints, the legal personnel involved in that process and their roles, as well as the rules of access to court and the documentation required for access to each forum.
Legal Practice and Procedures is designed to enable the learner to:
- Understand the functions and components of the Irish Legal System, types of courts, district, circuit, High, Courts of Appeal and Supreme; criminal, civil jurisdiction and specialist arbitration mechanisms such as the Employment Law fora and the Private Rental Tenancies Board, as well as the European Court of Justice and European Court of Human Rights
- Understand the sources of law operating within the Irish Legal System, Constitution, European, Statute and secondary laws
- Understand how jurisdiction operates, how and where the various types of jurisdiction are accessed within the Irish State, criminal and civil as well as specialist provisions such as employment statutory arbitrations
- Understand and operate the rules of access to the Irish Legal System
- Comprehend basic legal terminology and their appropriate use
- Distinguish the avenues of complaint appropriate to the complainant and the redress sought
- Familiarise themselves with the documents which commence legal proceedings
- Recognise and anticipate the components and formalities within the procedures of a court room, the legal personnel and their individual roles
- Be familiar with the format of an Employment Law complaint hearing, its process, personnel and their roles
Course Duration
The programme will be delivered in 15 sessions of centre based learning of 3 hours’ and 1 session of 2 hours and 2 courts based units observing the criminal and civil courts each of 6-hour duration. The classes will involve learning theory, principles and practical application of the theoretical concepts through problem solving, group work, in class presentations and case studies.

Assessment Schedule
There are specific methods which are required to be used as part of the assessment criteria for this module and they are:

Learners will have a reasonable standard of literacy.
It is recommended that learners have completed courses to a national framework level 3 or 4 standard or similar or have work experience commensurate with exhibiting that they will be able to provide evidence in written format for assessment purposes.
Demonstrate a capacity to engage in on-line research therefore learners will have very basic computer literacy skills.
GMB College provides literacy supports, has computer access and will assist learners with support arrangements where specialist needs are identified to the GMB College staff. Applicants who anticipate accessing such supports must request a meeting with the Programme Director in their application and complete the Special Considerations Form.

Upon completion of their course the learner can speak to the Programme Manager or Guidance Support Team to access the variety of transfer and progression options which are available to them.
The learner may also progress to other appropriate programmes leading to awards at the next level of the National Framework of Qualifications (NFQ) or they may be eligible to apply to progress to the next or higher levels of the (NFQ) with a higher education provider.
